Employers have a mandatory duty of care to maintain a safe workplace under Workplace Health and Safety Legislation. An important part of complying with this duty of care is ensuring their workers are fit to safely perform their role. This is necessary to make sure that an employee’s health is not at risk for their work, and also that their health won’t pose a risk to others in the workplace.
As such, Fitness for Duty assessments are at the employer’s discretion, but are for the benefit of the entire workplace.

Occupational and Environmental Physicians are the only medical specialists specifically trained and qualified to determine an individual’s fitness for duty. They do this utilising their knowledge of workplaces and the demands of specific jobs, and comparing this to the capacity that a worker has, and the risks that their health status poses. They are able to assess how medical conditions, illness or injury may affect an individual’s ability to function both at work and in normal daily activities.
